From my engine supplier:

"There is an imminent ban on the importation of mid frame 2 stroke bicycle engines coming Jan. 1, 2010. The old classification of CFR 90 Off-Road Non-Handheld Engine, has now changed to CFR 1051Off-Highway Motorcycle Engine. This means that restrictions are tougher for importation and clearing customs at the port of entry. Emissions control is one issue, the other would be the lack of a fuel tank with evaporative emissions control.

On the market presently are many 2 cycle bike engines that are being illegally smuggled into the country by large internet retailers with good connections in China. You will know it is smuggled illegally if the bike engine kit has a chrome muffler. A chrome muffler can not have a catalytic converter installed inside of it which is necessary to be approved by EPA. The chroming process ruins the catalytic converter. Generally these engines are much cheaper to make and of the lowest quality. The Canadians who ship engines into the US are "technically" breaking the law, but with no real method of enforcement. Actually, customs would consider the individual purchasers of non-EPA approved Canadian bike engines to be the importers and therefore those that buy the engines would be in violation.

The future of 2 cycle bike engines in my opinion is going downhill. The 2010 ban will even stop high quality 2 strokes from legally entering the country, yet poorly and cheaply made bike engines will become more expensive and thusly more prominent.
